Terms of Service

1. Overview and Scope

These Terms of Service govern your access to and use of the websites, customer accounts, localized storefronts, content, features, products, and services operated by Seventus collectively, the “Services.”

The Services include seventus.co, br.seventus.co, account.seventus.co, and any other current or future Seventus-operated domain, subdomain, regional storefront, or localized version of the store.

By accessing or using the Services, creating a customer account, or placing an order, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Services or place an order.

If you use the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least the age of majority in your jurisdiction or have the authorization and supervision of a parent or legal guardian who agrees to these Terms.

You may not use the Services if applicable law prohibits you from doing so or if Seventus has previously suspended your access for violating these Terms.

3. Mandatory Consumer Rights

Nothing in these Terms excludes, restricts, or replaces any consumer protection, product guarantee, warranty, privacy, delivery, refund, withdrawal, or other right that cannot legally be waived.

If applicable law provides you with greater protection than these Terms, the applicable legal requirement will control.

The inclusion of jurisdiction-specific language in these Terms or another Seventus policy does not mean that Seventus currently offers products or shipping in every referenced jurisdiction. Products and shipping methods are available only for destinations enabled at checkout.

4. Customer Accounts

Certain features may require or allow you to use a customer account. You are responsible for:

• Providing accurate and current information;

• Maintaining access to the email address used for authentication;

• Protecting account sign-in links, codes, and credentials;

• Reviewing activity associated with your account; and

• Notifying Seventus promptly if you suspect unauthorized access.

You may not access another person’s account without authorization or use an account to impersonate another person.

Seventus may restrict or suspend an account when reasonably necessary to investigate fraud, unauthorized activity, security concerns, or violations of these Terms.

5. Products and Made-to-Order Fulfillment

All physical products sold by Seventus are made to order and produced through independent production and fulfillment partners.

Seventus makes reasonable efforts to present product descriptions, materials, measurements, colors, designs, images, and other information accurately. However:

• Screen settings may affect how colors appear;

• Product images may be digital mockups;

• Measurements may have reasonable manufacturing tolerances;

• Print placement, stitching, texture, finish, or material appearance may vary slightly; and

• Packaging or minor product components may change when reasonably necessary.

These ordinary variations are not automatically defects. A product that materially differs from the confirmed order or has a verified production defect will be reviewed under our Return, Refund & Claims Policy and applicable law.

Product availability may depend on the selected variant, destination, production partner, carrier, legal restrictions, and market configuration. The appearance of a product on a regional storefront does not guarantee that it can be shipped to every address.

Seventus may limit quantities, restrict resale, remove products, or discontinue designs where reasonably necessary.

6. Orders and Acceptance

Review all order information carefully before completing checkout, including:

• Product;

• Size;

• Color;

• Variant;

• Quantity;

• Personalization;

• Recipient information;

• Shipping address;

• Shipping method; and

• Checkout currency and total.

After placing an order, you may receive an order confirmation. This confirms that the order was received but does not guarantee that production or fulfillment can be completed.

Seventus may refuse, place on hold, or cancel an order for reasonable grounds, including:

• Suspected fraud or unauthorized payment;

• Incorrect or incomplete order information;

• A pricing, description, or technical error;

• Product or production-partner unavailability;

• Unsupported or restricted delivery destinations;

• Violation of these Terms;

• Infringing, unlawful, or prohibited personalization content;

• A request from the payment provider, carrier, or government authority; or

• Compliance with applicable law.

If Seventus cancels a paid order, we will issue an appropriate refund to the original payment method unless the payment is subject to a lawful hold, dispute, chargeback, or other legal restriction.

7. Order Changes and Cancellations

If you need to change or cancel an order, contact Seventus immediately or use the available customer-account request feature.

A request is not approved until Seventus confirms it. Because orders may enter production shortly after purchase, we cannot guarantee a change or cancellation after an order has been submitted to a production partner.

Approved changes may affect price, taxes, production time, shipping cost, shipping method, or delivery estimates.

Additional cancellation rules are provided in our Return, Refund & Claims Policy.

8. Pricing, Currencies, and Payment

Seventus’s base store currency is United States dollars (“USD”). Depending on your location, selected market, storefront, and Shopify settings, prices may be displayed and charged in another supported currency.

Localized prices may be determined through:

• Currency conversion from USD;

• Current or manually configured exchange rates;

• Market-specific price adjustments;

• Price rounding;

• Local tax treatment; or

• Other Shopify Markets settings.

The currency, product price, shipping charge, taxes, discounts, and total displayed at checkout immediately before you submit the order are the amounts applicable to that transaction.

A currency selector changes how eligible prices are displayed or charged but does not guarantee that every currency, product, or shipping method is available in every market.

Your bank, card issuer, or payment provider may impose currency-conversion, foreign-transaction, or other fees outside Seventus’s control. Seventus is not responsible for those independently imposed charges except where applicable law provides otherwise.

Refunds are issued in accordance with the original transaction and payment method. Exchange-rate changes or payment-provider conversion practices may affect how a refund appears on your account.

Seventus may change prices prospectively at any time. A price change will not alter an already accepted order unless you approve a requested modification or a correction is permitted by law.

Payment is due at checkout. Orders may be held or canceled if payment cannot be authorized, verified, or completed.

9. Pricing Errors

Despite reasonable efforts, a product, discount, shipping charge, or other amount may occasionally be displayed incorrectly.

If we discover a material pricing error before fulfillment, Seventus may:

• Cancel the affected order and provide a refund; or

• Contact you to explain the correct amount and request confirmation before proceeding.

Seventus will not charge a corrected higher price without authorization when authorization is required.

10. Taxes, Customs, and Import Charges

Applicable sales tax, VAT, GST, or similar transaction tax may be calculated at checkout based on the order, product, destination, and available tax information.

International orders may also incur customs duties, import taxes, brokerage charges, carrier fees, or government assessments. Unless checkout or the order confirmation expressly states that such charges are included or prepaid, they may be collected separately from the recipient.

Additional information is provided in our Shipping Policy. Nothing in these Terms shifts a tax or import obligation contrary to applicable law.

11. Personalized and Customized Products

A personalized product may include a customer-submitted name, message, date, photograph, image, design instruction, monogram, or other customization.

You are responsible for reviewing and approving the spelling, capitalization, dates, images, placement instructions, and other personalization details before purchase.

By submitting personalization content, you represent that:

• You own the content or have permission to use it;

• Its use does not infringe another person’s copyright, trademark, privacy, publicity, or other rights;

• It is not unlawful, fraudulent, threatening, or abusive; and

• Seventus and its production partners may reproduce it as necessary to process and fulfill the order.

Seventus may reject or cancel a personalization request that we reasonably believe violates these Terms, applicable law, production requirements, or third-party rights.

Personalized products generally cannot be returned or exchanged for buyer’s remorse or a customer-submitted error once production has begun. Verified production errors and mandatory consumer rights remain eligible for review under our Return, Refund & Claims Policy.

12. Shipping and Delivery

Production time is separate from carrier transit time. Shipping methods, prices, origins, carriers, tracking, and estimated delivery dates vary by product, production partner, and destination.

Orders containing different products may be produced at different facilities and delivered in separate packages.

Delivery and production dates are estimates unless Seventus expressly identifies a date or service as guaranteed. Seventus will provide delay, cancellation, refund, or other remedies when required by applicable law.

Responsibility for loss or damage during transit is determined under applicable law. Nothing in these Terms transfers risk of loss to a customer earlier than legally permitted.

Shipping restrictions, customs requirements, tracking, delays, lost-package procedures, incorrect addresses, and return-to-sender shipments are governed by our Shipping Policy.

13. Returns, Refunds, and Product Claims

Returns, refunds, replacements, cancellations, defects, wrong items, damaged products, personalization errors, and other product claims are governed by our Return, Refund & Claims Policy.

Because all physical products are made to order, Seventus does not ordinarily accept returns or exchanges for buyer’s remorse, change of mind, or customer selection errors, except where applicable law provides otherwise.

Nothing in these Terms reduces any longer reporting period, warranty, withdrawal right, or remedy provided by mandatory law.

14. Promotions, Discounts, and Gift Cards

Promotions, discount codes, gift cards, free-shipping offers, and other special offers may be subject to additional terms presented with the offer.

Unless otherwise stated:

• Promotions cannot be combined;

• Promotions have no cash value;

• Discount codes must be entered before checkout is completed;

• Promotions may be limited by product, market, currency, customer, or date;

• Discounts cannot ordinarily be applied retroactively; and

• Seventus may cancel an offer affected by fraud, abuse, or a material technical error.

Gift-card use, expiration, redemption, and refundability remain subject to applicable law and any terms disclosed when the gift card is purchased.

15. Intellectual Property

The Services and their content—including Seventus names, department names, logos, designs, graphics, artwork, photographs, product presentations, text, layouts, and software—are owned by Seventus or used under authorization from their respective owners.

Third-party names, logos, products, and trademarks remain the property of their respective owners. Their appearance on the Services does not transfer ownership to Seventus or to the customer.

Purchasing a product transfers ownership of the physical item, subject to payment and applicable law. It does not transfer any copyright, trademark, design right, publicity right, license, or other intellectual-property interest in the underlying artwork or branding.

You may not reproduce, modify, distribute, sell, license, scrape, republish, or commercially exploit protected Seventus content without written permission, except as permitted by law.

16. Customer Content

“Customer Content” means reviews, comments, feedback, photographs, videos, personalization content, or other materials you submit.

You retain any ownership rights you have in Customer Content.

Public Content

When you intentionally submit content for public display, such as a product review or social-media submission, you grant Seventus a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and promote that content in connection with Seventus and the Services.

This license continues for as long as the content is used in the Services or associated promotional materials, subject to applicable privacy and intellectual-property law.

Personalization Content

Personalization content is licensed only as reasonably necessary to review, produce, fulfill, deliver, support, and document the customized order.

Claims Evidence

Photographs, videos, measurements, labels, and packaging evidence submitted for a claim may be used to investigate the claim, communicate with production partners or carriers, prevent fraud, improve quality, maintain records, and comply with law. Seventus will not use claims evidence for public marketing without additional permission.

You represent that you have the necessary rights to submit Customer Content and that it does not violate another person’s rights or applicable law.

Seventus may remove or decline to publish public content that is unlawful, fraudulent, infringing, abusive, unrelated, misleading, or otherwise violates these Terms.

17. Acceptable Use

You may not use the Services to:

• Violate any law or regulation;

• Infringe intellectual-property, privacy, publicity, or other rights;

• Submit fraudulent, deceptive, or unauthorized orders;

• Transmit malware, harmful code, or disruptive material;

• Interfere with the security or operation of the Services;

• Attempt unauthorized access to accounts, systems, or data;

• Scrape, crawl, copy, or extract store content through unauthorized automated means;

• Circumvent purchasing, security, market, shipping, or product restrictions;

• Harass, threaten, impersonate, or harm another person; or

• Use the Services for an unlawful commercial purpose.

18. Privacy

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy.

By submitting information to the Services, you acknowledge that it may be processed by Shopify and by service providers involved in payment, production, personalization, delivery, security, support, and other store operations as described in the Privacy Policy.

19. Third-Party Services and Links

The Services may use or link to third-party platforms, payment providers, production partners, carriers, social networks, applications, or websites.

Third parties may have their own terms and privacy policies. Seventus does not control independent third-party services and is not responsible for their content or practices, except to the extent that Seventus remains responsible under applicable law for services used to perform an order.

A third-party link does not, by itself, mean that Seventus endorses every statement, product, or practice of that third party.

20. Availability of the Services

Seventus does not guarantee that the website, customer accounts, currency selector, translations, checkout, or other Services will always be uninterrupted or error-free.

We may maintain, modify, suspend, or discontinue a feature when reasonably necessary for security, technical, operational, or legal reasons.

Temporary unavailability does not affect rights relating to an order already placed.

21. Disclaimer of Warranties

To the maximum extent permitted by law, the website and its technical features are provided on an “as available” basis. Seventus does not guarantee that the website will always be uninterrupted, completely secure, or free of technical errors or harmful components.

This technical disclaimer does not mean that physical products are sold without legally required protections.

Physical products remain subject to:

• Their applicable product descriptions;

• Our Return, Refund & Claims Policy;

• Any express warranty presented with the product; and

• Any implied warranty, legal guarantee, conformity requirement, or consumer remedy that cannot lawfully be excluded.

No warranty is disclaimed or limited where doing so would be prohibited by applicable law.

22. Limitation of Liability

To the maximum extent permitted by law, Seventus will not be liable for indirect, incidental, special, exemplary, or consequential losses that were not reasonably foreseeable when the applicable contract was formed.

For a claim arising from a particular order, Seventus’s aggregate contractual liability will not exceed the amount paid for the affected order, except where a greater remedy is required by law.

Nothing in these Terms excludes or limits liability for:

• Fraud or fraudulent misrepresentation;

• Willful misconduct or gross negligence where it cannot be limited;

• Death or personal injury caused by negligence where it cannot be limited;

• Defective or unsafe products where liability cannot be limited;

• Violation of mandatory privacy or data-protection rights;

• Breach of non-waivable consumer guarantees or warranties; or

• Any other liability that cannot legally be excluded or limited.

23. Indemnification

To the extent permitted by law, you agree to indemnify Seventus against third-party claims, losses, and reasonable expenses directly resulting from:

• Customer Content that unlawfully infringes another person’s rights;

• Your intentional misuse of the Services;

• Fraudulent or unlawful activity conducted through your account; or

• A material violation of these Terms.

This section does not require you to indemnify Seventus for Seventus’s own negligence, wrongful conduct, production errors, or failure to satisfy non-waivable legal obligations.

24. Force Majeure

Seventus will not be responsible for a delay or failure caused by circumstances beyond our reasonable control, such as natural disasters, severe weather, war, terrorism, civil unrest, epidemics, government actions, labor disruptions, carrier interruptions, supply-chain failures, power outages, internet failures, or production-facility emergencies.

When such an event affects an order, Seventus will make reasonable efforts to provide an update and resume performance.

This section does not eliminate any legally required right to set an additional performance deadline, cancel an order, receive a refund, or obtain another mandatory remedy.

25. Suspension and Termination

Seventus may suspend or terminate access to the Services when reasonably necessary because of:

• Fraud or unauthorized activity;

• A security threat;

• Unlawful conduct;

• Material or repeated violation of these Terms; or

• Conduct that harms Seventus, customers, service providers, or third parties.

Termination of website or account access does not eliminate payment obligations, privacy rights, refund rights, or other obligations connected with an existing order.

Sections that by their nature should survive termination—including intellectual property, payment obligations, liability limitations, dispute provisions, and provisions concerning Customer Content—will continue to apply.

26. Informal Dispute Resolution

Before beginning formal proceedings, you and Seventus agree to make a reasonable, good-faith effort to resolve the dispute informally.

This informal process does not prevent either party from seeking urgent relief, using an applicable small-claims procedure, meeting a legal filing deadline, or exercising a non-waivable consumer right.

27. Governing Law and Courts

These Terms are governed by the laws of the State of Georgia and applicable federal law of the United States, without regard to conflict-of-law rules.

Where permitted, disputes may be brought in a court with jurisdiction in Georgia, United States.

This choice of law and forum does not deprive a consumer of:

• Mandatory protections under the law of the consumer’s residence;

• The right to bring a claim in another court when applicable consumer law permits it; or

• Any right that cannot legally be waived by contract.

28. Localized Storefronts, Languages, and Translations

Seventus may offer localized storefronts, product information, currencies, and policy translations for particular markets.

Translations are provided to improve accessibility and understanding. We make reasonable efforts to keep translated versions consistent with the English version.

If a translated version conflicts with the English version, the English version will control to the extent permitted by law, unless the translated version expressly states that it is the controlling version for that market.

Mandatory local-language disclosures and non-waivable local consumer rights remain effective regardless of this section.

Activating a language, currency, domain, or subdomain does not by itself guarantee that checkout, products, or shipping are available in every country where that language or currency is used.

29. Changes to These Terms

Seventus may update these Terms to reflect changes in the Services, products, providers, markets, technology, or legal requirements.

The revised version will be posted with an updated “Last updated” date. We will provide additional notice of material changes when required by law.

Changes ordinarily apply prospectively. Orders placed before an update remain governed by the terms presented when the order was placed, except where a legal change must apply immediately or the parties agree otherwise.

30. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return, Refund & Claims Policy, and any product-specific or promotional terms presented during purchase, form the agreement governing the Services and purchases from Seventus.

Severability

If a provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed when necessary. The remaining provisions will continue in effect.

Waiver

Failure to enforce a provision does not waive the right to enforce it later. A waiver must be clear and in writing.

Assignment

You may not assign your rights or obligations under these Terms without Seventus’s consent.

Seventus may transfer these Terms as part of a merger, reorganization, financing, sale, or transfer of the business, provided that the transfer does not eliminate non-waivable customer rights.

Headings are included for organization and do not independently change the meaning of these Terms.
